OBLIGATIONS OF THE PROPRIETORS IN CORTIJO CABRERA IN POLÍGONO 1
i. The obligations indicated in the following were laid down in the escritura nr.742, dated 17th June 1983, authorised by D.Ramon Alonso Fernandez, notary public, resident of Dalias, and also indicated in the individual sales contracts.
ii. Those obligations will remain subject to the norms as indicated in the Statutes of the Junta de Compensación, the details as specified in the Plan de Urbanización of this Junta, the decisions taken in the General Assemblies of the Junta de Compensación “Cortijo Cabrera”, and the various laws and rules applicable in the municipality of Turre, Almeria.
iii. Plots are sold in their natural state within the boundaries shown in the urbanisation plan.
iv. The demarcation of one plot from the other and from the street is the entire responsibility of the owner and must be carried out within the norms established for each area in the urbanisation and to the approval of the Junta de Delegados.
v. The traditional style of architecture of Andalucia will be insisted upon. The purchaser must obtain approval of the Junta de Delegados for the plans of all new work prior to the commencement including house, villa or flat construction, swimming pools, garden walls, garages, pergolas etc., and all construction on the plots sold must be executed to the standards of workmanship currently in practice and the quality of finishing to the rest of the Estate particularly in respect of damp-proof courses, waterproof membranes under floors and roof cavity walls, adequate size plumbing and drainage.
vi. The Junta de Delegados must approve:
a. Design and construction of sewage systems
b. Colour of paintwork of all external walls and the exterior carpentry
c. Colour and type of roof cladding
d. Exterior aspects of the building
e. All extensions or reconstructions
To gain approval for the above please submit plans of intended changes for sanction, if approval is either not sought or has been declined but the owner has gone ahead with the changes then the Junta can exercise their right to demand that these alterations be reinstated to their original state at the owners cost.
All work must conform to the relevant building regulations and where necessary a building licence must be obtained from Turre town hall.
For the benefit and protection of all property owners on the Estate the owner undertakes to abstain from any action which adversely affects the value of the property of other owners or which harms, inconveniences or endangers the health and general well being of other owners and to this end covenants to observe the following rules:
• Not to make or allow to be made any loud or aggravating noise.
• Not to install any lights whose reflection or other effects can cause annoyance to other owners.
• Not to use or store any materials which produce offensive smells including those of organic fertilisers or to accumulate refuse or to leave unrepaired any faults to drain pipes, septic tanks etc..
• Not to permit the use except by express authorisation of the Junta de Delegados of any of the common services by third parties.
• Not to perform or allow any activities which could be harmful to the health of other residents or which could be dangerous.
• To light outside fires is absolutely prohibited between May and October and requires the express permission of the authorities at any other time of the year, extreme caution must be taken with barbecues, which should only be used with the immediate availability of fire-extinguishers especially when using carbon barbecues.
• Not to hang out or allow to be hung out washing visible from the rest of the Estate.
• Not to damage the Estate roads or allow any obstruction to vehicular circulation on the Estate roads by the inconsiderate parking of cars or lorries or the unloading and storage of materials.
• Not to park nor allow to be parked on any plot or any of the Estate roads, caravans, motorised campers, lorries, vans, trailers or constructional plant with the exception of cars, and any vehicle that is owned by the Junta de Compensación.
• Not to allow any tents or temporary structures.
• Not to install any type of radio or TV antenna without the express permission of the Junta de Delegados.
• All Satellite, T.V. Dishes, Air Conditioning units and solar panels etc., must be erected in an unobtrusive area where possible, and/or painted in the same colour of the exterior of the house
• Dogs must at no time be allowed to become a nuisance, inconvenience or danger to other owners or members of the public.
• Any damage caused to properties by unleashed or unaccompanied dogs will be the responsibility of the owner.
• All dog owners are responsible to clean up after their pets have been to the toilet etc.,
• Dogs must be kept on a leash at all times when outside the owners property
• Not to carry on or allow to be carried on any trade, profession or business activity of any kind without the approval of the Junta de Delegados, this is in addition to the pertinent permits required by the authorities.
• The owner undertakes to plant an adequate garden, which he will properly maintain and water as long as it is his property, and to transfer this obligation to his successors in title.
• The owner of any property wishing to dispose of any garden rubbish must not light a bonfire at any time of the year without the express permission of the Junta. They can however request (via the Junta office) to have it shredded and either keep it or have it bagged ready for disposal.
• The Junta de Compensación reserves a right of easement for an indefinite period for the purpose of the possible future installation of overhead or underground electricity lines, low and high tension, the installation of water mains, sewage pipes or surface water piping etc. The owner(s) will be consulted about the routing of such installations and the Junta expressly covenants to do the minimum damage possible to the owner’s land and to put right all or any damage caused in the execution thereof and with the minimum loss of amenity.
• With the object of preservation of general amenities no trees may be cut down without the written consent of the Junta de Delegados,
• All refuse must be kept in the outside cupboards provided for this purpose.
• It is not permitted to keep materials, household refuse or scrap of any kind on the plots, except in the course of construction, when those materials always must be kept orderly and tidy
• It is prohibited to put locks on the outside cupboards provided for refuse, the filter and water meter and the electricity meter.
